This document constitutes a legally binding agreement ("Agreement") between Engabao Beach Club and the guest ("Guest"). By purchasing services, participating in activities, or entering the premises, the Guest agrees to waive any and all rights to pursue legal action, including but not limited to lawsuits, claims, or demands, against Engabao Beach Club, its owners, employees, contractors, or agents ("Released Parties").

1. Safety and Security

At Engabao Beach Club, your safety is our top priority. The town of Puerto Engabao is a peaceful and welcoming community with minimal crime, making it an ideal destination for relaxation and exploration. Guests can feel secure while enjoying the tranquil surroundings and friendly local atmosphere.

While Engabao and Puerto Engabao are exceptionally safe, we advise taking precautions if you plan to travel to other parts of Ecuador, where crime rates may be higher. Stay informed, avoid high-risk areas, and exercise caution during your travels outside of Engabao and Puerto Engabao.

Rest assured, Engabao Beach Club is located in a secure and serene environment, allowing you to focus on enjoying your vacation to the fullest.

2. Reservation Policy

To ensure a seamless experience, guests must inform Engabao Beach Club of their desired travel dates. Guests have 2 years to use their vacation. Reservations are made on a first-come, first-served basis, and availability is not guaranteed for any specific dates until confirmed by Engabao Beach Club.

If your preferred travel dates are unavailable, don’t worry—our team will work closely with you to find alternative options that fit your plans.

​

Early communication of your travel dates helps secure your reservation and avoids any inconvenience. Thank you for your understanding and cooperation.

3. Commitment to Excellence, Service Availability, and Substitutions

Engabao Beach Club is committed to providing exceptional customer service in all aspects of your stay.

​

Corey and Evelin strive to be part of your experience, but their availability cannot always be guaranteed.

​

In their absence, services will be delivered by qualified substitutes, ensuring no impact on the overall quality of your experience.

For example:

If Corey is unavailable, a qualified local surf instructor will provide surf lessons.
If Evelin is unavailable, a skilled bartender from Engabao Beach Club will host the cocktail and mocktail class.

​

We ensure all substitute professionals are experienced and capable of delivering the high-quality experiences you expect.

4. Transportation Services

As part of our commitment to convenience, Engabao Beach Club provides a round trip taxi ride to and from Guayaquil Airport to Engabao Beach Club. This service is included with all All-Inclusive Packages unless otherwise noted.

Guests are responsible for transportation to any other destinations. However, Engabao Beach Club can assist in arranging transportation to alternative destinations. Please note that the Club is not responsible for these associated costs.

5. Assumption of Risk and Limited Liability

While we take every possible measure to ensure a safe, smooth, and enjoyable experience, the Guest acknowledges that certain factors are beyond our control. By engaging with Engabao Beach Club, the Guest voluntarily assumes all risks, including but not limited to:

Delays, hardships, or inconveniences, including cancellations or disruptions in travel.

Injuries, illnesses, accidents, or medical emergencies.

Loss, theft, or damage to personal property.

6. Package Terms

All packages are valid for two (2) years from the date of purchase.

​

Guests must inform Engabao Beach Club of their desired travel dates. Guests have 2 years to use their vacation. Meaning guests have 2 years from date of purchase to arrive and spend their vacation at Engabao Beach Club.

​

Refunds are not provided. However, Guests may request a change of travel dates at no additional cost within the package validity period.

​

In some instances, Engabao Beach Club may extend the two-year validity period for good reason.

​

7. Indemnification and Waiver of Liability

The Guest agrees to indemnify and hold harmless the Released Parties from any claims, liabilities, or expenses arising from their participation in Engabao Beach Club’s services and activities.

The Guest acknowledges and accepts that Engabao Beach Club is not liable for any unforeseen or unfortunate events, regardless of their nature.

8. Governing Law and Waiver of Legal Action

This Agreement is governed by the laws of the Republic of Ecuador. Any disputes arising under this Agreement shall be resolved exclusively through private arbitration in Ecuador.

The Guest agrees not to initiate or participate in any legal action, claim, or lawsuit against the Released Parties.

9. All-Inclusive Package Details

Our All-Inclusive Packages include unlimited beverages and three meals daily: breakfast, lunch, and dinner. Certain premium items may not be included in the package and will be available at an additional cost.

​

To ensure a safe and enjoyable environment for all guests, we reserve the right to limit alcohol consumption if necessary.

10. Acknowledgment and Acceptance

The Guest agrees to release Engabao Beach Club, its owners, employees, and affiliates ("Released Parties") from any liability, claims, or demands.

​

By purchasing a package, participating in services, or entering the premises of Engabao Beach Club, the Guest affirms that they have read, understood, and agreed to these Terms & Conditions.
